Board grants shed setback variance to Chapel Street resident
Zoning Board of Appeals · Meeting of January 5, 2026
Shirley Zoning Board approves shed variance despite zoning setback violation. Chair Kevin Kelly, Vice Chair Lee M. "Chip" Guercio, Mr.
Stuart Sears, and Associate Member Dustin White voted unanimously (4-0) to allow James Murdock to construct a 12-by-12-foot shed at 23 Chapel Street with a five-foot side yard setback, falling short of the required 15-foot minimum under Section 3.4.2(C)2 of the Protective Zoning Bylaws. Murdock had begun construction unaware of variance requirements and was ordered to cease by the Building Inspector. The Board also approved three peer review invoices for the ongoing Parker Village LLC 40B Comprehensive Permit project totaling $12,119.12 and continued that application's public hearing to February 2, 2026, with the Board's time to act extended to February 28, 2026.
